The Pattern Books and swatches supplied by S Ross & Co Ltd include important information with regard to characteristics and suitability of the fabric. We strongly advise that all relevant information is brought to the attention of your customers at the point of sale.
It is not possible to always obtain an exact colour match to the samples in our pattern books. Although every effort is made to control the colours, variations in shades can sometimes occur between different deliveries. If a close match is required please request a sample which will be sent quickly and free of charge. If this is acceptable the sample must be returned attached to your order specifying to match as sample. If this is not done we regret that we will not accept any liability for shade variations.
All upholstery pile fabrics are subject to pile pressure and creasing to some degree, but frequent turning of the cushions, where possible, and good general care of your upholstery will help to maintain the original appearance of the fabric. All cushion interiors, which are used with pile fabrics, must be lined. On all Chenilles we recommend overlocking, seam allowances of two centimetres and minimum eight stitches per two and a half centimetres.
Upholstered furniture should not be exposed to long periods of direct sunlight and should be cleaned regularly following the advice in our pattern books.
We regret that under no circumstances are we able to consider any complaints where fabrics have been treated with chemicals or agents not recommended by ourselves.
Goods are supplied by us on the condition that our liability for any fault or defect in the quality, condition, description or fitness for any purpose, is limited in amount to a sum not exceeding the purchase price of the particular goods.
Please ensure that the correct fabric and metreage as ordered has been received by you before cutting. NO FABRIC WILL BE ACCEPTED FOR RETURN, FOR ANY REASON, AFTER IT HAS BEEN CUT.
Claims for non-arrival, shortages & damages must be made within 14 days of our invoice date. Shortages and damaged goods should be signed for as such, and Ross Fabrics notified immediately.
Prior approval must be obtained from the Company before any return will be accepted. The Company will not accept the return of fabric more than 1 month after its date of delivery except in the case of defective fabric. We reserve the right to impose a 20 % handling charge and a return carriage charge on all returns which result from circumstances outside our control. No credit on outward carriage charges will be allowed on these parcels.
Trading styles and details of credit account customers are or have been provided to us on a credit account application form. Any changes to these details, including ownership, address and trading style must be notified to S Ross & Co Ltd trading as Ross Fabrics in writing.
E C Customers (except UK) should also notify S Ross & Co Ltd of changes to either their VAT status or VAT registration number. Completion of an up to date application form is required to confirm changes to details of credit account customers, any changes will not be effective until acknowledged by ourselves in writing.
Unless a credit account facility is in place, all goods must be paid for in full before despatch. Otherwise payments must be received by us prior to the end of the month following date of invoice. Accounts not paid within these dates are considered overdue, and this may result in further supplies being withheld until payment has been received. Serious or continual non-compliance with our payment terms may result in the removal of credit facilities. Credit accounts that are not used for several consecutive months will be deemed to be not required and may be removed.
Customers failing to pay invoices by their due date (whether before or after judgement) will incur interest charges on a daily basis from the date that payment was due at a rate of 5% over the base rate as quoted by Barclays Bank plc and shall additionally reimburse to S Ross & Co Ltd all costs and expenses (including legal costs) incurred in the collection of any overdue amount.
Whenever a cheque is returned unpaid by the Bank it will be subject to an administration charge.
Title (of ownership) to goods supplied by S Ross & Co Ltd, trading as Ross Fabrics (the Seller), remains the property of the Seller until all indebtedness to the Seller has been discharged on all current and previous contracts of sale.
These conditions and any act or contract to which they apply shall be governed by English Law and any dispute arising out of any act or contract to which these conditions apply shall be subject to the exclusive jurisdiction of the English Courts.
Data (both corporate and personal) provided on the account application form and accumulated during the course of our trading relationship will be utilised internally in the normal course of business. On occasions this data will be shared with authorised Credit Rating Agencies and the company Credit Insurers when Credit Account Facilities are required or requested and any information received as a result of such enquiries will be retained by the company. Ross Fabrics will not share (or sell on) your data to any other 3rd Party (except where legally required to do so by a government agency) without your express written authority. This document will be retained in its manual form in folders in the Ross Fabrics office. Essential (but minimal) information is stored on our main computer system in the form of an Account File (business name, address, phone no. & main contact) for the purposes of processing sales orders and payments.
The Ross Fabrics website (www.rossfabrics.co.uk) contains digital representations of the majority of fabrics offered. Due to the inherent difficulties in achieving accurate representations of fabric in a digital format the website should only be used as an initial reference and fabric selections should not be made solely on the basis of the website. We would strongly recommend referring to our Pattern books or requesting fabric samples before ordering a fabric.
The qualities listed as FR have been manufactured to comply with BS5852, Part 1:Ignition Source 1 (Match), and Ignition Source 0 (Cigarette), as laid out in the Furniture and Furnishings (Fire Safety) regulations 1988.
